Renewable Energy & Waste Management

|
Planning policy on renewable energy and
waste management is central to sustainable
development in Ireland. The National Climate
Change Strategy provides a framework for
mitigation of climate change across all
sectors of the economy. Planning policy aims
to facilitate measures which seek to reduce
emissions of greenhouse gases and to encourage the production of energy from
renewable sources, including biomass, waste
material, solar, wave and wind energy.
In 2004 the Department of Environment and
Local Government published Taking Stock and
Moving Forward, a waste policy statement
which built on the 1998 guidelines Changing
Our Ways. These guidelines form the basis of
waste management planning in Ireland,
encouraging a reduction in the reliance on
landfill and greater participation by the
private sector in waste management.

Part V - Social & Affordable Housing
Agreements |
|
| |
|
Under Part V of the Planning and Development
Act 2000 it is necessary, for the majority
of new housing developments, to enter into
an agreement with the planning authority to
provide for social and affordable housing.
An agreement can be for the transfer of
land, sites or houses either within the
development, or at an alternative site. In
exceptional circumstances a payment to the
planning authority, in lieu of transfer, is
also an option.
McCutcheon Mulcahy has been involved in
negotiating a significant number of Part V
Agreements for both small and large-scale
developments and are able to provide the

the Retail Planning Guidelines in 2000 and
the subsequent Retail Strategies. Retail

sustainable picture.

Impact Assessment |

Environmental Impact Assessment
|

|
In the case of certain large scale, or other
sensitive developments an Environmental
Impact Assessment (EIA) must be carried out.
The results of the EIA are collated into an
Environmental Impact Statement (EIS) which
must accompany relevant planning
applications.
The objective of an EIS is to outline the
possible impacts of the proposed development
and identify the mitigation measures which
will be taken to limit any potential
negative effects on the environment.
An EIS will require input from a number of
specialist consultants covering a wide range
of issues including, traffic, noise, air,
soil, water, flora and fauna, archaeology
and landscape and the possible impacts on,
or of, these factors by the proposed
development.

relationships with specialists in all these
areas and are skilled in ensuring the timely
delivery of comprehensive reports for our
clients. Our service includes the
co-ordination of the EIS from screening, to
scoping, preparation, publication and
submission.
