Renewable Energy & Waste Management  
   
Planning policy on renewable energy and waste management is central to sustainable development in Ireland. The National Climate Change Strategy provides a framework for mitigation of climate change across all sectors of the economy. Planning policy aims to facilitate measures which seek to reduce emissions of greenhouse gases and to encourage the production of energy from renewable sources, including biomass, waste material, solar, wave and wind energy.

In 2004 the Department of Environment and Local Government published Taking Stock and Moving Forward, a waste policy statement which built on the 1998 guidelines Changing Our Ways. These guidelines form the basis of waste management planning in Ireland, encouraging a reduction in the reliance on landfill and greater participation by the private sector in waste management.

McCutcheon Mulcahy has been involved in a number of planning applications and appeals related to waste management and renewable energy. We are skilled in presenting development proposals within the context of national and international policy.

Part V - Social & Affordable Housing Agreements  
   
Under Part V of the Planning and Development Act 2000 it is necessary, for the majority of new housing developments, to enter into an agreement with the planning authority to provide for social and affordable housing. An agreement can be for the transfer of land, sites or houses either within the development, or at an alternative site. In exceptional circumstances a payment to the planning authority, in lieu of transfer, is also an option.

McCutcheon Mulcahy has been involved in negotiating a significant number of Part V Agreements for both small and large-scale developments and are able to provide the following services:
  • Advice on how Part V will impact on development proposals
  • Applications for exemption certificates
  • Negotiation of agreements to meet the requirements of Part V of the Planning Acts 2000 to 2002
  • Drafting of Part V proposals

Retailing  
   
A much more methodical approach to the location and development of retailing in recent times has resulted with the advent of the Retail Planning Guidelines in 2000 and the subsequent Retail Strategies. Retail development is no longer solely driven by market conditions, but by a number of other factors which address a much broader sustainable picture.

We at McCutcheon Mulcahy have the knowledge and expertise required to analyse all aspects of retailing - from town centre analysis to identifying and evaluating sites for new development through Sequential Testing and Retail Impact Assessment - and extensive experience in bringing such projects through the planning process, in the delivery of strategic and local retail development, for both the public and the private sector.

Retail Impact Assessment  
   
We offer our clients expert advice on current retail planning policies covering all aspects of the assessment of retail impact, namely:
  • Identification of catchment area
  • An estimation of cashflow available within the identified area
  • An idea of turnover of existing retail centres within the identified area and their likely impact on a new development

Environmental Impact Assessment  
   
In the case of certain large scale, or other sensitive developments an Environmental Impact Assessment (EIA) must be carried out.

The results of the EIA are collated into an Environmental Impact Statement (EIS) which must accompany relevant planning applications.

The objective of an EIS is to outline the possible impacts of the proposed development and identify the mitigation measures which will be taken to limit any potential negative effects on the environment.

An EIS will require input from a number of specialist consultants covering a wide range of issues including, traffic, noise, air, soil, water, flora and fauna, archaeology and landscape and the possible impacts on, or of, these factors by the proposed development.

McCutcheon Mulcahy has built close working relationships with specialists in all these areas and are skilled in ensuring the timely delivery of comprehensive reports for our clients. Our service includes the co-ordination of the EIS from screening, to scoping, preparation, publication and submission.
